These terms govern BBehavior Autism Services’ optional client and caregiver text messaging program through Nextiva. By affirmatively opting in, you agree to receive the general administrative messages described here at the number you provide. Text messages do not provide clinical care or replace approved secure communication channels.
Program Purpose
Messages may include requests to contact our office, general administrative notices, and generic reminders to review updates or complete paperwork in an approved secure portal. Texts will identify BBehavior but will not name the client or disclose appointment details, treatment information, or other PHI. Scheduling, intake, and service-related details must be handled through an approved secure channel. This program does not send marketing or promotional messages.
Consent and Enrollment
Consent is obtained before program messages are sent, using BBehavior’s optional client consent form or another approved, documented process with equivalent disclosures. You must actively select the consent option; no preselected boxes or mandatory enrollment are used. You may submit intake forms without opting in. Providing a mobile number alone does not enroll you. You confirm that you are authorized to use the number provided and will notify us if it changes or is reassigned. Each recipient must consent for their own number; one caregiver’s consent does not enroll another caregiver.
Voluntary Participation
Text messaging is not a condition of receiving care, purchasing services, or participating in BBehavior programs. Declining or withdrawing consent will not affect your care, eligibility, access to services, or relationship with BBehavior. We will communicate with you through other established channels when you decline or opt out.
Message Frequency and Costs
Message frequency varies with administrative communication needs. Message and data rates may apply to messages sent or received under your mobile carrier’s plan. BBehavior does not charge a separate fee to join this program. Contact your carrier if you have questions about charges.
Opt Out and Reenrollment
Reply STOP at any time to unsubscribe. You may also tell BBehavior staff that you no longer want texts or call 407-707-5531, extension 4857. We honor requests promptly. You may receive a single opt-out confirmation; no further program messages will be sent unless you affirmatively opt in again. Reply START to request reenrollment where supported, or complete a new consent form. Reenrollment must be recorded before program messages resume.
Help and Delivery
Reply HELP for assistance or call 407-707-5531, extension 4857. Message delivery depends on your device, carrier, service availability, and number status. Delivery may be delayed or fail. Carriers are not liable for delayed or undelivered messages. Do not rely on texting as the sole means of communicating time-sensitive matters; use BBehavior’s established escalation process when needed.
PHI and Sensitive Information
Please do not send or request protected health information (PHI) through this program. Standard Nextiva SMS/MMS is not an approved PHI channel. Do not text client names or initials, appointment details, dates of birth, diagnoses, treatment or behavior information, insurance records, photographs, screenshots, or attachments containing client information. Do not send Social Security numbers, financial details, passwords, or identity documents by text.
Texts must remain general and direct you to an approved secure channel for client details. For example:
BBehavior Autism Services: Please review your secure portal for an update. Reply STOP to opt out.
PHI must not appear in text messages, URLs, link previews, attachments, or group messages.
Consent to this program is not a HIPAA authorization and does not waive your privacy rights or BBehavior’s obligations to protect health information. Client information must be handled in approved secure clinical channels by authorized personnel. A BAA for other Nextiva services does not make standard SMS/MMS an approved PHI channel.
Accidental Disclosures and Emergencies
If you accidentally send sensitive information, stop the text exchange and contact our office through an approved channel. Ask for the Privacy Officer and follow instructions for incident reporting. Do not repeat or forward the information in another text. Texts are not continuously monitored and must not be used for medical emergencies, urgent clinical concerns, or crisis response. Call 911 for an emergency. For nonemergency clinical questions, contact your care team through an approved secure channel.
Privacy
Your mobile number, consent record, and message information are handled under BBehavior’s Text Messaging Privacy Policy. We do not sell or share mobile information or consent for third-party or affiliate marketing. Necessary service-provider processing supports this program only.

Changes and Contact
BBehavior may update these terms and will publish the current version with its effective date. Updates do not create consent for new message purposes; appropriate new consent must be obtained before expanding the program. For program questions, call 407-707-5531, extension 4857. For privacy questions, ask for Daniel Rodriguez, Privacy Officer.
